Entire site code copied - potential SEO issues?

Hi folks,
We have noticed that our site has been directly duplicated by another site. They have copied the entire code, including the JS, CSS and most of the HTML and have simply switched their own text and images onto the template. (We discovered it because they even copied over our analytics tracking and were appearing in our reports - duh!)
Does anyone know if there are potential SEO issues in copying the code like that, or do duplicate content issues only apply to indexable HTML content?

(I didn't want to out them by sharing their URL because it could have been an external contractor that built the site and they probably had no idea.)

I agree with Moosa that it's likely not a problem. That said, I think it can be a problem when the "chrome" of closely related sites start linking together aggressively. One tactics spammers use in link networks is using the same content templates again and again, and I wouldn't be surprised if Google used this in their detection algorithms.
On the other hand, Google has also said they look at site structure and design elements when determining if sites on separate subdomains (but the same root domain) should be considered part of the same site for ranking/link purposes.
Regardless, in your case I think you should have little to worry about.

I personally don’t think there is such penalty on duplicate code as it is available on duplicate content...this is mainly because there are billions of people using Wordpress and as it is a CMS so the basic code will be same only JS and CSS is changed from website to website...
Infect, I have seen many people using the same JS and CSS on more than two websites just by changing the design of the website....I personally believe there is no problem from the SEO stand point.. But obviously ethically copying the code of the website is not good!

Tools to scan entire site for duplicate content?
HI guys, Just wondering if anyone knows of any tools to scan a site for duplicate content (with other sites on the web). Looking to quickly identify product pages containing duplicate content/duplicate product descriptions for E-commerce based websites. I know copy scape can which can check up to 10,000 pages in a single operation with Batch Search. But just wondering if there is anything else on the market i should consider looking at? Subdomains + SEO
Hi everyone, So a little background - my company launched a new website (http://www.everyaction.com). The homepage is currently hosted on an amazon s3 bucket while the blog and landing pages are hosted within Hubspot. My question is - is that going to end up hurting our SEO in the long run? I've seen a much slower uptick in search engine traffic than I'm used to seeing when launching new sites and I'm wondering if that's because people are sharing the blog.everyaction.com url on social (which then wouldn't benefit just everyaction.com?) Seo site architecture - how deep?
Hello Moz community! We are building out a site for a web hosting/web design company. I am wondering if we should just have home/categories/pages or if we should have home/categories/sub-categories/pages. I am am not sure if by adding the additional level we can create a bunch of mini-hubs within the categories. For example: Home/Web hosting/Business Web Hosting/Small Business Web Hosting I don't know if these mini-hubs within the category are a good idea or if I should keep it as flat as possible? Any thoughts on this?

Competitior 'scraped' entire site - pretty much - what to do?
I just discovered a competitor in the insurance lead generation space has completely copied my client's site's architecture, page names, titles, even the form, tweaking a word or two here or there to prevent 100% 'scraping'. We put a lot of time into the site, only to have everything 'stolen'. What can we do about this? My client is very upset. I looked into filing a 'scraper' report through Google but the slight modifications to content technically don't make it a 'scraped' site. Please advise to what course of action we can take, if any.
