Is Google's reinclusion request process flawed?

We have been having a bit of a nightmare with a Google penalty (please see http://www.browsermedia.co.uk/2012/04/25/negative-seo-or-google-just-getting-it-painfully-wrong/ or http://econsultancy.com/uk/blog/10093-why-google-needs-to-be-less-kafkaesque for background information - any thoughts on why we have been penalised would be very, very welcome!) which has highlighted a slightly alarming aspect of Google's reinclusion process.
As far as I can see (using Google Analytics), supporting material prepared as part of a reinclusion request is basically ignored. I have just written an open letter to the search quality team at http://www.browsermedia.co.uk/2012/06/19/dear-matt-cutts/ which gives more detail but the short story is that the supporting evidence that we prepared as part of a request was NOT viewed by anyone at Google.
Has anyone monitored this before and experienced the same thing? Does anyone have any suggestions regarding how to navigate the treacherous waters of resolving a penalty?
This no doubt sounds like a sob story for us, but I do think that this is a potentially big issue and one that I would love to explore more.
If anyone could contribute from the search quality team, we would love to hear your thoughts!

I agree that they must be swamped and most of the 'complaints' you can see on the Google forums fully deserve to be penalised in my humble opinion, but I think that the total lack of communication is more damaging than helpful.
If they want to improve the web, why do they not give more details about what is causing the problem? By being more transparent and helping webmasters to eradicate spammy techniques, everyone will be forced into improving their sites for all the right reasons.
If they don't have the resource to handle the reinclusion requests, then they shouldn't have it as an option.
I still feel that it is very poor not to even look at the files that were prepared - that shows a lack of respect.
I agree that it is likely to be something simple. The 'spike' theory is still the strongest contender for me, due to the timings of events, but that is alarming if it proves to be true as we were effectively penalised for doing exactly what Google encourages (creating good content that will naturally attract links).
Another possible cause is the fact that we have got a number of directory links over the years. Whilst I have never considered these to be high quality links, I have never seen Google saying that you shouldn't submit your site to them (indeed, they used to actively suggest that submitting to Yahoo! was a good idea) and it is a way for Google to outsource some human assessment of sites (assuming that the directories do check your sites).
If it is the directories, then the door for negative SEO is so wide open that it is alarming. As many have said, completely ignoring such links would be better than penalising you.
We are still no closer to understanding what we have done wrong, despite every effort to adhere to the guidelines and a lot of work trying to audit / document our link profile. With very little faith in the reinclusion process, where can we possibly turn to now?
We will see. There were multiple views of the open letter from Google, so somebody somewhere has seen it and I just hope that there is some form of response.
The irony is that we spend most of our life defending Google and encouraging clients to improve what they are doing online. On this occasion, I really find it hard to defend them. I appreciate that we are a drop in a mighty ocean, but the principle is one that I think is an important one and one that I will pursue.

Not sticking up for them but you have to appreciate the amount of people that would probably try to send them all sorts of viruses anyway they can, also they probably don;t have or want to take the time looking at everyone so closely, basically they will just see if the offending stuff is still there, if it is they won't give you any love.
Honestly, it's probably something so simple you have overlooked it. Keyword ratio's above 6% can be taken as spam depending on content amount, non relevent link coming in/going out, links from already penalzed sites, anything unnatural is now what google has been focusing on, not just backlinks, so go through your site, obviously the HP is the first point to start at, if you are really sure there is nothing going on in the way of spaminess or over optimization, comb through your other pages. It will usually be a problem one your best ranked pages. Or, ex best ranked pages if you have been hit with a penguin slap.

A client rebranded a few years ago and doesn't want to be associated with it's old brand name. He wishes not to appear when the old brand is searched in Google, is there something we can do?
The problem is there was redirection between the old branded site and the new one, and now when you type in the name of the old brand, the new one comes up. I have desperately tried to convince this client there is nothing we can do about it, dozens of news articles crop up with the two brands together as this was a hot topic a few years ago, but just in case I missed something I thought I'd ask the community of experts here on Moz. An example for this would be Tyco Healthcare that became covidien in 2007. When you type tyco healthcare, covidien crops up here and there. Any ideas? Thanks!

Does location of my VPS and IP adress matter to Google's ranking?
We're busy with adding a German version of our webshop. Right now we're quit successful in The Netherlands with our webshop and SEO. I wonder if Google minds the location of the website (VPS) and IP address concerning SEO for our German webshop. If I Google on this subject I can not find a clear answer. Can somebody help me?

Silly Question still - Because I am paying high to google adwords is it possible google can't rank me high in organic?
Hello All, My ecommerce site gone in penalty more than 3 years before and within 3 months I got message from google penalty removed. Since then till date my organic ranking is very worst. In this 3 years I improved my site onpage very great. If I compare my site with all other competitors who are ranking in top 10 then my onpage that includes all schema, reviews, sitemap, header tags, meta's etc, social media, site structure, most imp speed, google page speed insight score, pingdom, w3c errors, alexa rank, global rank, UI, offers, design, content, code to text raito, engagement rate, page views, time on site etc all my sites always good compare to competitors. They also have few backlinks I do have few backlinks only. I am doing very high google adwords and my conversion rate is very very good. But do you think because I am paying since last 3 year high to google because of that google have some setting or strategy that those who perform well in adwords so not to bring up in organic? Is it possible I can talk with google on this? If yes then what will be the medium of conversation? Pls give some valuable inputs I am performing very much in paid so user end site is very very well. How do you find old linking url's that contain uppercase letters?
We have recently moved our back office systems, on the old system we had the ability to use upper and lower case letters int he url's. On the new system we can only use lower case, which we are happy with. However any old url's being used from external sites to link into us that still have uppercase letterign now hit the 404 error page. So, how do we find them and any solutions? What's the best way to manage content that is shared on two sites and keep both sites in search results?
I manage two sites that share some content. Currently we do not use a cross-domain canonical URL and allow both sites to be fully indexed. For business reasons, we want both sites to appear in results and need both to accumulate PR and other SEO/Social metrics. How can I manage the threat of duplicate content and still make sure business needs are met?

Question is why the rankings and traffic are going down down down the last 4 months. Costumer thinks he got hit by google penguin update(s). The site has about 600 page’s/posts al ‘optimized’ for old seo:
- Almost all posts are superb optimized for one keyword combination (like … coloring pages) there is a high keyword density on the keyword titles and descriptions are all the same like: <keyword>and this is the rest of my title, This is my description <keyword>and i like it internal linking is all with a ‘perfect’ keyword anchor text there is a ok backlink profile, not much links to inner pages

What I was thinking to do. rewrite the content to a smaller text. Low keyword density on the keyword and put the coloring pages up front. rewrite all titles and descriptions to unique titles and descriptions Make some internal links to related posts with a other anchor text. get linkbuilding going on inner pages get more social signals Am I on the right track? Culling 99% of a website's pages. Will this cause irreparable damage?
I have a large travel site that has over 140,000 pages. The problem I have is that the majority of pages are filled with dupe content. When Panda came in, our rankings were obliterated, so I am trying to isolate the unique content on the site and go forward with that. The problem is, the site has been going for over 10 years, with every man and his dog copying content from it. It seems that our travel guides have been largely left untouched and are the only unique content that I can find. We have 1000 travel guides in total. My first question is, would reducing 140,000 pages to just 1,000 ruin the site's authority in any way? The site does use internal linking within these pages, so culling them will remove thousands of internal links throughout the site. Also, am I right in saying that the link juice should now move to the more important pages with unique content, if redirects are set up correctly? And finally, how would you go about redirecting all theses pages? I will be culling a huge amount of hotel pages, would you consider redirecting all of these to the generic hotels page of the site?
