Link spam outranking me... how and why?!

Can anyone tell me why compertors doing this kind of spam is outranking me?
One of my main competitors also has links in the footer of:
http://www.cricketlinks.net/default.asp?country=SA
This one competitor has nearly 2000 links coming from just 8 root domains. I've been avoiding this stuff like the plague but sometimes it makes you wonder...

Sam, my friend...please never think along those lines like how and why someone doing spam or blackhat tactics and still be able to rank high in search engines. Even if someone from Google guarantees me in written that there won't be anything happening to my site if I go the blackhat way, I will still stay away from those as I am here to stay forever and I never ever think of doing anything that the search engines frown upon. Please don't bother about those who do blackhat and still get away with it. Thinking along those lines itself is incorrect. Let them do and they will repent one fine day. Today, there are thousands if not lakhs of sites that do not follow the guidelines of search engines and are still ranking high. Just because they are doing good despite their shady tactics, we should not follow them or even bother or worry about them. Its obvious that they are not doing the right thing and we just have to laugh when we see them. They won't last long. Here is the deal, if you want to be here forever, then stay clean.Only quality content and quality links can secure you a lasting high rank in Google.

Spammy links
Hi I was reviewing a clients link profile and found a lot of the links they have pointed at their domain have the anchor text "Buy Viagra" or "buy viagra online" and similar. Now the website has absolutely nothing to do with this kind of business so no doubt these links are spammy. To my knowledge the website has not been penalised by Google so far. Is it best to disavow or just leave alone? Kind Regards

Nasty links
Hi My first q on here (hoorah!), and it's about links (boo!). I've got what appears to be a handful (but worryingly, increasing in number) of links pointing to my site like this: http://condos.mrgulffront.com/florida-condos-for-sale/320-scenic-gulf-drive-miramar-beach-fl-32550-mls-567591/ I've made contact with the sites concerned, and had only one positive response who flatly denied all knowledge of it. The issue (as far as I can see) is that as in the above example the links (on the bottom right in the grey box) are forever changing so not always visible. Can anyone offer any guidance as to these kinds of nasty links.... I'm right at the v beginning on this "path of seo understanding" so please don't assume prior knowledge! Thanks in advance.... tom

Link Relevance vs Link Authority ?
Hi guys, I have a quick question regarding some low quality links my site is getting. From the information in Open Site Explorer, the website Im talking about has a page authority of 16 while the domain authority is 11\. These are very low quality scores in my oppinion and Im thinking of removing them with Google Disavow Tool. The thing is that, although the domain is low quality, the links have relevance as they're in the same business sector as us. More exactly, the name of the domain is taxisavona and the company I work for is also a taxi company. I have an ecommerce website and a manufacturer is providing links directly to my website from their products pages because they do not sell directly online. What is my best linking juice power for this situation:
